VARIABLE TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your use of the Variable websites, applications, and services (the “Service”), operated by Variable Technologies Inc. (“Variable,” “we,” “us”). By using the Service, you agree to these Terms.

1) Eligibility and account setup

The Service is intended for parents and legal guardians. You must be at least 18 years old to use the Service.

You are responsible for maintaining the confidentiality and security of your account access (including your email account used for magic link login), and for all activity that occurs through your account.

2) Parent-provided child information

The Service allows you to enter information about your child, including name and age. You represent that you are the parent or legal guardian of the child (or otherwise authorized) and that you have the right to provide this information.

3) License and acceptable use

We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use, subject to these Terms.

You agree not to:

• Use the Service in any way that violates applicable laws
• Attempt to access or disrupt systems or data you are not authorized to access
• Reverse engineer, copy, or resell the Service or its outputs at scale
• Upload or transmit malicious code

4) Worksheets and generated content

The Service may generate learning activities, worksheets, or related materials (“Outputs”).

• For personal use: You may download and print Outputs for your household use.
• No commercial use: You may not sell, publish, or distribute Outputs commercially (including as bundles online) without our written permission.
• No guarantees: Outputs are educational materials and may contain errors. You are responsible for reviewing materials for appropriateness for your child.
• No professional advice: The Service is not medical, psychological, or educational therapy advice.

5) Intellectual property

The Service, including its software, design, templates, and underlying skill logic, is owned by Variable and protected by intellectual property laws.

You retain rights to the information you provide (e.g., your child’s name/age), subject to the rights you grant us to operate the Service.

6) Feedback

If you provide feedback, suggestions, or ideas, you grant us the right to use them without restriction or compensation.

7) Privacy

Our Privacy Policy describes how we collect, use, and share information. By using the Service, you agree to our Privacy Policy.

8) Beta nature of the Service

The Service may be offered as an early-access or beta product. Features may change, be removed, or be unavailable at times. We do not guarantee uninterrupted operation.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, VARIABLE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VARIABLE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

IN ANY EVENT, VARIABLE’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED $100.

12) Indemnification

You agree to indemnify and hold Variable harmless from claims arising out of your use of the Service or your violation of these Terms.

13) Governing law and venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. You agree to exclusive venue and jurisdiction in the state or federal courts located in Delaware.

14) Changes to the Terms

We may update these Terms from time to time. We will post the updated version and change the “Last updated” date. Continued use of the Service after changes means you accept the updated Terms.
